Terms of Service

These Terms are the agreement between you and Soma AI LLC, a California limited liability company doing business as Soma Labs and listed as Soma AI LLC on Google Play and the App Store (“Soma Labs”, “we”, “us”), for our games and related services, including any games we release in the future, and any website or feature we offer under the Soma Labs name (together, the “Services”). These Terms apply to every Soma Labs game, whether or not it is named here. By downloading, installing, or playing, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Services.

1. Who can play

You must be at least 13 years old to use the Services. If you are under 18, you may only use the Services with the permission of a parent or legal guardian who agrees to these Terms on your behalf. Our games are not directed at children under 13, and we do not knowingly collect personal information from them.

2. Your account

When you first play, we create an anonymous player account, identified by a random ID and a secret key stored on your device, so we can save your progress on your device and on our servers. There is no sign-in. Some games can bring your player back when you reinstall on the same phone or restore a phone backup, but we can’t promise this, and progress may not move to a new device. Using Delete my data always starts a new player. You may later be able to link your player account to a sign-in provider such as Apple or Google so you can restore it on another device.

If a game lets you choose a display name, it must not impersonate anyone or be offensive, hateful or misleading. We may change or remove a name that breaks this rule.

You are responsible for the devices you use to play and for keeping your sign-in details private. You may not sell, transfer, or share your account, and you may not access another person’s account without permission. We may suspend or close accounts that break these Terms.

3. License to play

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and play our games on devices you own or control, for your own entertainment. Everything in the Services, including the games, artwork, characters, sounds, code, puzzles, and the Soma Labs name and the names and logos of our games, belongs to Soma Labs or our licensors and is protected by copyright, trademark, and other laws. Apart from the license above, no rights are granted to you.

You agree not to:

• copy, modify, distribute, sell, or rent any part of the Services;
• reverse engineer, decompile, or try to extract the source code of the games, except where the law expressly allows it;
• use cheats, bots, automation, exploits, or unauthorized third-party software that interacts with the Services;
• interfere with the Services or their servers, or try to access accounts, data, or systems you are not authorized to access;
• use the Services for anything unlawful, or to harass, harm, or deceive anyone.

4. Purchases and virtual items

Our games may offer virtual items such as coins, hints, reveals, eggs, cosmetic items, prizes for daily streaks or leaderboards, or time-limited ad-free passes (“Virtual Items”). Some are free, some may be earned by watching an advertisement, and some may be purchased with real money as an in-app purchase.

Virtual Items are a limited license to use a feature inside the game. They have no real-world value, cannot be exchanged for money or anything of value outside the game, and cannot be transferred to another person or account. We may change, limit, or remove Virtual Items at any time as part of updating the game, and Virtual Items are lost if your account is closed or the game is discontinued.

A time-limited pass (for example, no ads between levels for 7 or 30 days) starts when it is bought, runs for that many days whether or not you play, and buying another adds its days to what is left. Passes and coins are kept on the device where they were bought and are not restored if you delete the game or its data.

In-app purchases are made through the Apple App Store or Google Play, and their terms and refund policies apply to those purchases. We do not process or see your payment card details. Except where required by law or by the store’s policy, all purchases are final and non-refundable. Prices may change at any time.

5. Advertising

Our games are supported by advertising. Ads are provided by third-party advertising partners, such as AppLovin and the ad networks it works with, including Meta. Some ads are optional “rewarded” ads that you choose to watch in exchange for a Virtual Item. We do not control the content of third-party ads, and advertisers and ad networks are responsible for their own content and practices. How advertising partners use data is described in our Privacy Policy, along with your choices for limiting ad tracking.

6. Updates and availability

We may update, change, or discontinue the Services or any feature at any time, with or without notice. Updates may be required to keep playing. The Services may be unavailable from time to time for maintenance, outages, or reasons outside our control, and we are not liable for any downtime or loss of progress.

7. Feedback

If you send us ideas, suggestions, or feedback, you agree we can use them freely without any obligation to you.

8. Ending these Terms

You may stop using the Services at any time by deleting the game. We may suspend or terminate your access at any time if we reasonably believe you have broken these Terms, if required by law, or if we discontinue the Services. Sections 3, 4, 9, 10, 11, and 12 continue to apply after termination.

9. Disclaimers

The Services are provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not promise that the Services will be error-free, uninterrupted, secure, or free of harmful components, or that your progress or Virtual Items will never be lost.

10. Limitation of liability

To the fullest extent permitted by law, Soma Labs and its owners, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, progress, Virtual Items, profits, or goodwill, arising out of or relating to the Services or these Terms. Our total liability to you for any claim will not exceed the greater of the amount you paid us in the 12 months before the claim or 50 US dollars. Some jurisdictions do not allow these limits, so they may not fully apply to you.

11. Indemnity

You agree to defend and indemnify Soma Labs against claims, damages, and expenses (including reasonable legal fees) arising from your breach of these Terms or your misuse of the Services.

12. Governing law and disputes

These Terms are governed by the laws of the State of California and the United States, without regard to conflict-of-law rules. Any dispute that cannot be resolved informally will be brought exclusively in the state or federal courts located in California, and you consent to their jurisdiction. Before filing a claim, please contact us so we can try to resolve it with you.

13. App store terms

If you downloaded a game from the Apple App Store or Google Play, you also agree to that store’s terms. Apple and Google are not parties to these Terms, have no obligation to provide support or maintenance, and are not responsible for the games. Apple and its subsidiaries are third-party beneficiaries of these Terms for iOS apps and may enforce them against you.

14. Changes to these Terms

We may update these Terms from time to time. When we make meaningful changes we will post the new Terms here, update the date at the top, and where appropriate let you know in the game. Continuing to play after a change means you accept the updated Terms.
